For 消费者 contracts entered on or after 1 October, the Act places courts under a duty to consider the fairness of terms in litigation concerning 消费者 contracts. 各种监管机构还具有违反不公平条款规定的执行权。

2015年消费者权益法 - unfair terms in 消费者 contracts - Part 1

For 消费者 contracts entered on or after 1 October, the Act updates existing laws providing that unfair contract terms are not binding on a 消费者.  

A term will be unfair if, contrary to the requirement of good faith, it causes a significant imbalance in the parties’ rights and obligations under the contract to the detriment of the 消费者. Whether a term is fair is determined:

The Act additionally requires traders to ensure that all their written terms in 消费者 contracts and notices are transparent, and provides that any ambiguous terms will be interpreted in the manner most favourable to the 消费者.

The Act introduces specific provisions concerning information provided to 消费者s by or on behalf of traders supplying services.   In respect of contracts entered on or after 1 October, anything said or written to a 消费者 by or on behalf of a trader about the trader or service will be treated as a term of the contract if:

• It is taken into account by the 消费者 when deciding to enter the contract; or
• It is taken into account by the 消费者 when making any decision about the service after entering into the contract.

Anything of that nature taken into account by the 消费者 is however subject to:

• Anything that qualified it and was said or written to the 消费者 by the trader on the same occasion; and
• Any change to it that has been expressly agreed between the 消费者 and the trader (whether before entering the contract or later).

As with goods and services, the Act gives 消费者s a set of statutory rights that cannot be excluded. The 数字内容 must be:

In addition, the pre-contract information provided by a trader under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 is to be treated as included 作为合同条款。

As with goods, the Act brings in a statutory implied term that the trader has the right to sell or transfer the 数字内容 to the 消费者.

An additional remedy is available for 数字内容 which entitles the 消费者 to claim for damage caused to his own hardware or software by the 数字内容. This is available to a 消费者 even where the 数字内容 is supplied for free.

Chapter 4 of the 2015年消费者权益法 sets out the new statutory framework for contracts between a trader and a 消费者 for the supply of a service. Contracts of employment and apprenticeships are expressly excluded from the scope of Chapter 4.

As with contracts for the supply of goods, the Act provides both statutory rights and statutory remedies for contracts for the supply of services. In summary, the statutory rights for 消费者s are:

In addition to other remedies which might be available, a 消费者 will have statutory remedies in certain situations if the service does not conform to the contract, namely:

Chapter 2 of the 2015年消费者权益法 (which comes into force on 1 2015年10月) applies to contracts between traders and 消费者s for the supply of goods (as specified). The Act brings together provisions relating to contracts for the supply of goods which are contained in several other pieces of legislation.

The Act sets out a 消费者's 法定权利，包括以下条款：
